Terms of Service
of Dinamic5
These terms define your rights and obligations when using the Dinamic5 system. Please read them carefully before getting started.

1. Definitions
"The Company" — Dinamic5, the operator of the CRM system and the website dinamic5.com.
"The Service" — the CRM system in all its components, including the website, application, API and related features.
"The User" — any person or entity that has registered for the Service or uses it.
"Account" — the account created for the User upon registration for the Service.
2. Acceptance of Terms
By registering for or using the Service, the User confirms that they have read, understood and agreed to these Terms of Service in their entirety. If you do not agree to the terms, please refrain from using the Service.
The Company may update these terms from time to time. Material changes will be published on the website and registered users will be notified. Continued use of the Service after an update constitutes acceptance of the updated terms.
3. Description of the Service
Dinamic5 provides a cloud-based CRM system for managing customers, sales, projects, marketing and business communications. The Service includes, among other things:
- Customer and lead management
- Sales and deal management
- Project and task management
- Automations and workflows
- WhatsApp, email and SMS marketing
- Quotes and digital signatures
- Payment processing
- Cloud PBX (virtual phone system)
- Third-party integrations
- Mobile application

4. Registration and Account
To use the Service, you must register and provide accurate, up-to-date information. The User is responsible for:
- Maintaining the confidentiality of login credentials
- All activity performed under their account
- Updating account details if they change
- Immediately notifying the Company of suspected unauthorized use
The Company reserves the right to refuse to open an account or close an existing account at its discretion, including in cases of violation of these terms.
5. Free Trial
Dinamic5 offers a 14-day free trial period. During this period:
- No credit card is required
- The User receives full access to system features
- At the end of the trial, a paid plan must be selected to continue
- Data entered during the trial is preserved after upgrade
6. Pricing and Payment
Published prices exclude applicable taxes. Payment is made in advance — monthly or annually, as selected by the User.
- The Company may update prices with 30 days advance notice
- Plan upgrades take effect immediately; the difference is charged proportionally
- Plan downgrades take effect at the start of the next billing period
- Non-payment may result in account suspension
7. Permitted and Prohibited Use
7.1 Permitted Use
The Service is intended for legitimate business use only, including customer management, sales, marketing and business communications.
7.2 Prohibited Use
The User agrees not to:
- Use the Service for illegal activity
- Send spam or unsolicited marketing messages
- Copy, duplicate or reverse-engineer the system
- Attempt to penetrate systems or accounts of other users
- Transfer the account or access to third parties without authorization
- Use the Service in a way that degrades performance for other users
- Transmit offensive, threatening, harassing or illegal content
8. Intellectual Property
All rights in the Service, including source code, design, logos, content and documentation, belong to the Company and are protected by intellectual property laws.
The User receives a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms. This license does not grant any proprietary rights in the Service.
Content that the User enters into the system remains their full property. The Company will not use user content for its own purposes, except as necessary to provide the Service.
9. Service Availability and SLA
The Company strives for 99.9% uptime or higher. However, the Service may be unavailable from time to time due to:
- Scheduled maintenance — with at least 24 hours advance notice
- Unforeseen technical issues
- Force Majeure events
The Company is not liable for damages caused by temporary unavailability of the Service.
10. Limitation of Liability
The Service is provided "AS IS." The Company does not guarantee that the Service will be error-free or uninterrupted.
In no event shall the Company's liability exceed the amount paid by the User in the preceding 12 months. The Company shall not be liable for indirect, consequential, special or punitive damages.
11. Cancellation and Service Termination
The User may cancel their subscription at any time through the management interface or by contacting support.
- Cancellation takes effect at the end of the current billing period
- After cancellation, data is retained for 30 days and then deleted
- Data can be exported before cancellation
The Company may suspend or close an account with 7 days advance notice in case of terms violation, and immediately in severe cases.
12. Indemnification
The User agrees to indemnify the Company for any damage, loss, expense or claim arising from violation of these terms, including reasonable attorney fees.
13. Governing Law and Jurisdiction
These Terms of Service are governed exclusively by Israeli law. Exclusive jurisdiction for any matter relating to these terms shall be with the competent courts in the Tel Aviv district.
14. Severability
If any provision of these terms is found to be illegal or unenforceable, the remaining provisions shall remain in full force and effect.
